The Collectionist

Terms and Conditions

These terms and conditions apply to all offers, orders, and agreements between The Collectionist and the customer. By placing an order, you agree to these terms.

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. The Collectionist
    The sole proprietorship trading under the name The Collectionist, established in the Netherlands, registered with the Chamber of Commerce under number 60931345, VAT identification number NL002123208B07.
  2. Consumer
    The natural person who is acting for purposes which are outside their trade, business, craft or profession.
  3. Customer
    Any natural or legal person who enters into an agreement with The Collectionist.
  4. Agreement
    Any distance contract between The Collectionist and the customer.
  5. Product
    All goods offered by The Collectionist, including vintage, antique and second-hand objects.

Article 2 – Applicability

  1. These terms and conditions apply to every offer from The Collectionist and to every agreement concluded.
  2. Before placing an order, the customer will be given the opportunity to consult and save these terms and conditions.
  3. By placing an order, the customer declares to agree with these terms and conditions.
  4. Deviations are only valid if agreed upon in writing.

Article 3 – The offer

  1. The offer contains as accurate a description as possible of the products offered.
  2. As these are often unique objects, minor deviations may occur.
  3. Images represent the product as faithfully as possible. Minor deviations in colour or detail may arise due to lighting, photography, or screen settings.
  4. Obvious mistakes or errors in the offer do not bind The Collectionist.

Article 4 – Condition of the product

The products offered are often vintage, antique or second-hand and may show traces of use, age or patina.

Minor imperfections, signs of wear, discolouration or restorations are considered part of the normal condition of the object and do not constitute a defect, provided they are consistent with the nature and age of the product.

The Collectionist strives to describe and photograph products as accurately as possible.

Article 5 – Formation of the agreement

  1. The agreement is formed when the customer completes the order and payment has been received.
  2. After formation, the customer will receive a confirmation by email.
  3. The Collectionist reserves the right to refuse an order for justified reasons.

Article 6 – Prices and payment

  1. All prices are stated in euros and include VAT, unless otherwise indicated.
  2. Payment takes place via the payment methods offered during checkout.
  3. Any shipping costs will be clearly displayed before completing the order.
  4. Part of the assortment consists of margin goods to which the VAT margin scheme applies. In that case, VAT is included in the price, but not stated separately and not deductible for business customers.

Article 7 – Delivery

  1. Delivery takes place at the address specified by the customer.
  2. Stated delivery times are indicative.
  3. The risk of loss or damage transfers at the time of delivery to the customer.

Article 8 – Right of withdrawal

  1. The consumer has the right to withdraw from the agreement within 14 days of receipt without giving reasons.
  2. The consumer reports the withdrawal by email or via the return policy.
  3. After notification, the consumer has 14 days to return the product.
  4. The direct costs of returning the order are entirely borne by the consumer. We do not reimburse return shipments.
  5. The risk of return shipping lies with the consumer until the product has been received by The Collectionist.
  6. The refund will take place within 14 days of receipt of the return shipment or proof of shipment.

Article 9 – Exclusion of the right of withdrawal

The right of withdrawal is excluded for products that:

  • are manufactured according to the consumer's specifications
  • are clearly personalised
  • cannot be returned for hygienic reasons

Article 10 – Warranty and conformity

  1. The statutory warranty applies to all products.
  2. Products must comply with what can reasonably be expected.
  3. Traces of use and signs of age do not in themselves constitute a defect.

Article 11 – Liability

  1. The Collectionist is not liable for indirect damage, unless there is intent or gross negligence.
  2. To the extent permitted by law, liability is limited to the amount of the order.

Article 12 – Complaints

  1. Complaints can be reported via hello@thecollectionist.nl.
  2. Complaints will be handled within a reasonable period.

Article 13 – Privacy

Personal data is processed in accordance with the privacy policy.

Article 14 – Applicable law

  1. All agreements are governed by Dutch law.
  2. Disputes will be submitted to the competent court in the Netherlands.
